Matching Monster's Terms and Conditions section is VERY important and must be agreed to for you to become a member. However, we want you to be aware of some additional - and even some redundant from Terms and Conditions - terms that apply to membership with Matching Monster that you also have to agree to for membership and subscription. Some should be common sense - such as advisement NOT giving anyone your personal financial information EVER - and other terms are more legal in manner:
1. Membership and Subscription - Pricing. You may become a Member of Matching Monster at no cost. As a Member, you will have the ability to participate in some, but not all, of the features and services available within the Service. In order to access additional features and services, including the ability to communicate with other Members, you must become a paying subscriber to the Service. Please note that the subscription policies that are disclosed to you in subscribing to the service are deemed part of this Agreement. For purposes of this Agreement the term "Member" includes subscribers, unless where its usage indicates otherwise. From time to time, Matching Monster may remove the profiles of non-subscribers.
2. Account Security. You are responsible for maintaining the confidentiality of the username and password that you designate during the Registration process, and you are fully responsible for all activities that occur under yourusername and password. You agree to (a) immediately notify Matching Monster of any unauthorized use of your username or password or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Matching Monster will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. If you share your computer with others, you may wish to consider disabling your auto-sign in feature.
3. Interaction with other members. You are solely responsible for your interactions with other members. You understand that Matching Monster does not in any way screen its members, nor does Matching Monster inquire into the backgrounds of its members or attempt to verify the statements of its members. Matching Monster makes no representations or warranties as to the conduct of its members or their compatibility with any current or future members. In NO EVENT shall Matching Monster be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of this service, including without limitation: bodily injury, emotional distress and/or any other damages resulting from communications or meetings with other registered users of this service or persons you meet through this service. You agree to take reasonable precautions in all interactions with other members of this service, particularly if you decide to meet offline or in operson. In addition, you understand that Matching Monster makes no guarantees, either express or implied, regarding your ultimate compatibility with individuals you meet through this service. You should NOT provide any personal financial information (for example: your debit or credit card information) to other members.
4. Member Demeanor. Matching Monster requests that all members conduct themselves in a ladylike or gentlemanly manner when writing profiles and using Matching Monster's other communication tools. Use of foul or offensive language isprohibited and such use can result in forfeiture of membership without any right to a refund. The following is a partial list of prohibited content for the Website that:
- is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- harasses or advocates harassment of another person;
- involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
- promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
- promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
- contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
- provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
- provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
- solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
- engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes
5. Matching Monster Reservation of rights. Matching Monster expressly reserves the right to immediately modify, suspend or terminate Member's account and refuse current or future use of any Matching Monster service without explanation or refund. Failure to abide by proper conduct or failure to provide full payment will result in forfeiture of event/membership participation. No refunds will be provided in such instances.
6. Prohibited Activities. Matching Monster reserves the right to investigate and terminate your membership if you have misused the Service, or behaved in a way whichcould be regarded as inappropriate or whose conduct is unlawful orillegal. The following is a partial list of the type of actions thatyou may not engage in with respect to the Service: - You will not impersonate any person or entity.
- You will not "stalk" or otherwise harass any person.
- You will not express or imply that any statements you make are endorsedby Matching Monster without our specific prior written consent.
- You will not use any robot, spider, sitesearch/retrieval application, or other manual or automatic device orprocess to retrieve, index, "data mine", or in any way reproduce orcircumvent the navigational structure or presentation of the Service orits contents.
- You will not post, distribute or reproduce inany way any copyrighted material, trademarks, or other proprietaryinformation without obtaining the prior consent of the owner of suchproprietary rights.
- You will not remove any copyright, trademark or other proprietary rights notices contained in the Service.
- You will not interfere with or disrupt the Services or the site or theservers or networks connected to the Services or the site.
- You will not post, email or otherwise transmitany material that contains software viruses or any other computer code,files or programs designed to interrupt, destroy or limit thefunctionality of any computer software or hardware ortelecommunications equipment.
- You will not forge headers or otherwise manipulate identifiers in order to disguise the origin of anyinformation transmitted through the Service.
- You will not "frame" or "mirror" any part ofthe Service or the Website, without Matching Monster's prior writtenauthorization. You also shall not use meta tags or code or otherdevices containing any reference to Matching Monster or the Service or thesite in order to direct any person to any other web site for anypurpose.
- You will not modify, adapt, sublicense,translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or the Website or any software used on or for the Service or cause others to do so.
